Toban Schreyer, now 36, was arrested in 2008 after the Wolseley house he inhabited his wife and three kids was destroyed by fire.
Court of Queen's Bench Justice Deborah McCawley ended Toban Schreyer's three-year court battle last week by ruling that the statement of police officers who interrogated him inadmissible. Without that evidence, the charges were stayed.
Schreyer's schizophrenia led police to target him and was also used against him in the interrogation, lawyers argued.
Toban's father Edward Schreyer was NDP premier of Manitoba from 1969-77, and Governor General of Canada from 1978-84.
