Police say a couple caught having sex on the patio of a Florida restaurant won't face charges for their interlude because none of the witnesses wanted to give statements to police.

Police said they were called to Paddy Murphy's in Orlando after patrons saw Jeremy Calo, 32, and his date "having sex on a table in view of minor children," according to the report Tuesday night on Local 6 News.

The report said the couple started making out and then it escalated.

The outdoor table is in plain view of restaurant customers and passersby.

Restaurant manager Tom Murphy told Local 6 he warned the couple to stop and then called the cops when they didn't.

Calo was arrested for fighting with Murphy and refusing to pay his $101 bill, but neither he nor his date were charged for the public sex acts.
